I have a number of ideas and some of which should not be made public on the forum to be effective.
The first research that needs to be done is to determine what laws are being violated, are they State or Federal? Are their other regulations that would apply. Like during the closure, there were citations given to individuals that violated the closure. I will find out what they were cited with violating.
The BLM can only enforce Federal laws and regulations especially when the County of San Bernardino removed their ability to enforce state law on Federal land. Therefore, if these are state laws, the enforcing agency would be the SB Sheriff's Department and the District Attorney.
There are two avenues to go in the process of bringing criminal charges. The Sheriff's Department can be called and a report taken. If they did not actually see the crime, they would have to file a report, hopefully investigate and then turn the information over to the District Attorney's Office for their decision on whether to bring charges. The other avenue is a person has the right to do a citizen's arrest of someone that they witness committing a crime. The citizen can call the Sheriff's Department and advise that they want to conduct a citizen's arrest. The person would then sign a verified complaint about the crime and I believe the district attorney's office would still have the decision about bringing charges.
In addition, I would recommend contacting CORVA (California Off Road Vehicle Association) about these problems. Contrary to what you may believe, CORVA does not approve of illegal OHV activity. They would assist you with your concerns. They are a very powerful group and have much more influence with the BLM than any of us. We may also want to look into getting grants to fund enforcement.
However, I believe that this is a much larger picture involving the local BLM office and Chief Ranger Barry Nelson. I encourage the documenting these illegal activities and sending to the appropriate agencies to document their response to the problem and to hold them accountable.
I believe that if we were to truly pursue BLM law enforcement and financial records that we would find inconsistencies. I would like to pursue this route and would need funding for the cost of some of these records and support to push for them. The FOIA allows for these records to be provided at no cost if we can clearly demonstrate the overriding public need for them.

With regard to Moss Mill Road, I believe that I can clearly show that the BLM has been repeatedly lying, evading and obstructing the truth to Congressman Lewis' Office about the status of this road. The BLM's intentional lies about Moss Mill Road has resulted in actual physical as well as psychological injuries to members of the American public. The BLM and Mike Castro's actions with regard to Moss Mill Road violate numerous Federal laws. After I have sent the letter, I will post it on the forum.
In addition, I am being provided assistance and guidance on where to send this information for the greatest impact. It would help if I had others who would join me in these efforts.
Please be very careful out there. Do not be confrontational. Document, document and document. We need to do this in a lawful manner. If we all join together on this issue, we can be effective.
