Thank you, katrina island, your post provides a lot more info. As you say, Scardino's vehicle was parked outside all night so the damage could have been done well after Scardino left Bowen Ranch. There is no solid proof that it happened at Bowen Ranch. I have never seen Mike's gun. I haven't been to Bowen Ranch much; however, I'll take your word that he has a 9mm. Of course, living in such a rural area, I think that he would be foolish not to own a gun. The judge has no obligation to "determine where the Bowen Ranch property line is." It is part of the legal obligation of the plaintiff to bring sufficient evidence into court to fully substantiate his/her claim. In this matter, that wasn't done. As a defense, Mike Castro simply told the judge that the damage was not done while the vehicle was parked upon his property. Well, don't become too optimistic. From what has been posted on this forum, which is probably far from being complete, Mike Castro may prevail. The plaintiff has the responsibility to prove his claim with a proponderence of evidence. I don't think (from what has been posted) that the plaintiff has done that.
