Actually we have been thinking about his case and since the alleged probation violation is "possession with intent to sell", the county actually entrapped this guy. The court provided him with plant numbers that he could legally grow. Then arrests him for alleged "possession with intent to sell"? Doesn't that sound like entrapment? How can they know what his intent was? I have not heard from him as of yet. Violation of his probation because he grew plants as allowed by his court order. Itsn't that ironic? He didn't even grow the maximum numbers as agreed upon in his court order. I will write to him and look into his legal remedies. We have helped him in his prior cases where the county conducted themselves illegally in so many ways. He decided to accept a plea bargain on his prior cases and in that plea bargain plant numbers were set.
This is actually a crime against the people because the people expressed their wishes by voting in favor of proposition 215.
Usually a person might do a habeus corpus, however, that would land him in Federal Court which has other ideas concerning our medical marijuana laws.
