I agree with your observations. However, the question is who is going to enforce these rules down there? The Forest Service does not have the resources and a private citizen does not have the authority.by katrina island - Deep Creek Hot Springs, Apple Valley, California
In 1975, the owners of the Bowen Ranch Building evicted the Ware Family (tenants of Fred Moss) from the Ranch. The Grams Family moved into the Bowen Ranch building as the tenant of Hoffman, Bekermus, and Kapelusz. The Ware Family then moved back over to the Moss Ranch. John Ware would attempt to divert the public through the Moss Ranch to collect tolls. There were many newspaper and other storiby katrina island - Deep Creek Hot Springs, Apple Valley, California
Mike Castro may be attempting to use adverse possession to gain title to the building. However, in order to gain adverse possession the person has to enter the building with some kind of title or right (which Mike does not have), has to be done nonviolently (which Mike has been threatening and violent) and the person has to pay the taxes for five years (which Mike has not). I firmly believe that these issues will be resolved in the near future. I really didn't anticipate that it would take this long.by katrina island - Deep Creek Hot Springs, Apple Valley, California
Yes DCHS, Inc. did enter into that purchase contract. Yes our purchase of the land and the buildings is still valid. Yes we intend to evict Mike Castro.by katrina island - Deep Creek Hot Springs, Apple Valley, California
A prescriptive easement is much like adverse possession. It is an interest developed over a period of time. If the public openly and continuously uses a road to access an area for a period of five years, the public can develop a prescriptive right to use that road for access.by katrina island - Deep Creek Hot Springs, Apple Valley, California
I don't see where Wizard spoke proudly about creating his own trail. DCHS, Inc. does not advocate creating new trails. However, DCHS, Inc. can see why this may have occurred. When an established road and trail have been closed (especially in an illegal manner), the public will find another way around. Like when the rocks were pulled down onto Moss Mill Road, the public created a bypass arouby katrina island - Deep Creek Hot Springs, Apple Valley, California
Jobe it was not the Forest Service who had difficulties with their dump pass, it was the Bureau of Land Management. More to come on that later.by katrina island - Deep Creek Hot Springs, Apple Valley, California
Very enjoyable reading and I can't agree with you more on this one. I really enjoy the camaraderie we feel and enjoy when we are in this magical place. We are extremely lucky that we can have these experiences.by katrina island - Deep Creek Hot Springs, Apple Valley, California
In 1992 Mike Castro and numerous other individuals were forming the Friends of Deep Creek and planning to take possession of the Bowen Ranch from Tow Truck Terry. The Friends of Deep Creek knew that Fred Moss only owned the land and so did Mike Castro. Just look at the minutes of their incorporator's meeting. <A HREF="http://www.deepcreekhotsprings.org/friends.html">Friends ofby katrina island - Deep Creek Hot Springs, Apple Valley, California
I think we should be thinking of solutions for the future. I am sure the Forest Service is concerned about these issues. If we have thought about these issues and developed some possible solutions, we will be one step ahead when the time comes.by katrina island - Deep Creek Hot Springs, Apple Valley, California
