What remains in question is the utility of the easement.
Current record states that it is across the east 30 feet of the property, while the actual route is outside that specifed area.
Is it necessary to relocate the route or does historic use set definition?
I have seen other cases in the local area where easements are defined at the edge of a property, but the actual routes are located for utility.
In this case, locating the route within the 30 foot easement would necessitate climbing a hill rather than going around it.
