July 31, 2003: "Now let me respond definitively to the question of the legal status of that road and particularly the portion that crosses the 40-acres now owned by the BLM. Our copy of the official deed conveying ownership from ARC-Las Flores Limited Partnership to the United States for the 40-acre parcel does not include a public access easement. An examination of the earlier chain of title clearly indicates that the owner of the 40-acre property in question is allowed ingress and egress, which clearly limits the ingress and egress to the United States and its agents, not Ms. Fry or any other member of the public."

We finally have the BLM admitting that there is an easement for ingress and egress, however, the BLM states that the easement can only be used by the United States and its agents. The problem is that when land is transferred to the United States of America it becomes public land or public domains land.

Land owned by the United States of America is land owned by the public and managed by the BLM. Therefore, the public is the owner and the public has the right to use that easement.
