Nancy Bates filed a wrongful death lawsuit against Mike Castro. For the record, I never accused Mike Castro of murdering Ronnie Bates. I have brought up the question about why Mike Castro didn't turn in Ronnie Bates' car for over three months and why Mike Castro was evasive when questioned about the car while it was parked in the Bowen Ranch parking lot.

During the wrongful death lawsuit against Mike Castro; Mike Castro filed a cross-complaint for libel, slander against Nancy Bates, DCHS, Inc., ********, William Schweiss and Gary Roe. Nancy Bates' Attorney filed a special motion to strike the cross-complaint. The website became an issue because Nancy Bates' phone number was on the website. The Judge determined that the website did show Mike Castro in a bad light and did not award Nancy Bates attorney fees for the special motion to strike.

DCHS, Inc., ********, William Schweiss and Gary Roe were never served by Mike Castro. ******** and William Schweiss appeared several times at the court hearings and were never served. Obviously, Mike Castro did not really want to sue us or he would have served us. It was during this period of time that Mike Castro chased Gary Roe on motorcycles causing Gary Roe to crash and sustain injuries.

The end result was that the cross-complaint was dismissed as to Nancy Bates and since we were never served, we were never parties in the case.

This cross-complaint has never had any affect on the website or its contents. Under civil code of procedure 425.16, speech is protected if it is a public issue, the speech is conducted in a public forum (such as a website), the issues have been submitted to the appropriate government authorities (which it was). I am not worried about being sued for libel, slander by Mike Castro. I have been exposing the truth and will continue to do so.
