Wizard, the The California Code of Regulations Title 14 contains the rules that the public must follow within the California State Parks. CCR section 4322 regulates nudity within the State Parks. It states following:

Nudity. No person shall appear nude while in any unit except in authorized areas set aside for that purpose by the Department. The word nude as used herein means unclothed or in such a state of undress as to expose any part or portion of the pubic or anal region or genitalia of any person or any portion of the breast at or below the areola thereof of any female person.

Section 4322 is a public nudity regulation and should not be confused with indecent exposure or lewd conduct. Since it only addresses the issue of simple nudity such as sunbathing or skinny-dipping, it is not a registerable sex offense.

Section 4322 can be cited as either an infraction, or a misdemeanor. The fine for an infraction is about $200 and about $400 for a misdemeanor. The fines are about the same as for littering or excessive noise in the park.

Only 3 citations have been issued at San Onofre Beach since May. The appearances have not yet been scheduled in San Doiego court but all defendants have been represented by an attorney.

What's happening now at San Onofre is that most naturists move south of the Park boundaries onto the Camp Pendleton beach. Although illegal, the Marines rarely use the beach so naturists rarely get hassled.

There have been NO citations at Blacks Beach issued under Section 4322. However, there have been a couple citations issued at Blacks for lewd behavior- a different charge. I've talked to the Torrey Pines State Beach rangers at length and they are fully aware of the new law, but they still follow the Cahill Policy, i.e. no citation unless a complaint is filed with them.

Regarding REmington, I talked with a Kern District ranger a short time ago and he said they have no immediate plans to destroy the pools. They are doing a complete analysis of the options. Nevertheless, the Friends of Remington and Sam D are closely monitoring the situation, and signing the petition can't hurt.
