I heard from a some friends of Davids and mine that they were near a resolution to an agreement at the last hearing. But, the victim protested and David was back in jail.

I heard the same. But I also heard the DA came back with another offer (more prison time) and Dave is wanting to go to trial instead. If convicted in a trial, he will probably get enough time to be a life sentence.
