Let's talk about FACTS here:
Katrina says that indeed Mike Catro, et al, OWNS the Bowen Ranch -- all 80 acres. Ownership means HE (and partners) OWN it - NOT DCHS, Inc!
Here's what I've heard directly from Mike Castro:
Mike indeed originally purchased the entire 80 acres some 10 years ago and sold the east 40 to unnamed friends just recently. On this east 40, is an old road that allows access to the trail head to the Springs from Bowen Ranch Road outside Bowen Ranch itself.
DCHS, Inc is claiming that it has a legal easement from use of that road, and is attempting to force the issue. The problem is, there NEVER was a legal easement that gives USE of that road by anyone but the owners of another parcel of land adjacent to Bowen Ranch.
I think what DCHS, Inc is claiming is something akin to "Squatter's Rights", since they used that road over a period of time they think they are entitled to permanent use of that road....and not only USE of the road based on Squatter's Rights, but OWNERSHIP of the LAND and BUILDINGS as well!
That road was intented to give ingress and egress to that 3rd party parcel adjacent to the Bowen Ranch, IF and ONLY if that 3rd party ever built a home on that land. It never happened. That land changed hands a couple times, but no home was ever built. The land eventually was given to the gov't and the legal rights to ingress/egress to that parcel was permanently terminated.
DCHS, Inc continues to claim it has a right to use that road (claiming Squatter's Rights) and that is the basis for their claim to the land and buildings at Bowen Ranch, which I find rather amusing - and absurd.
