No OMG. I wouldn't want you to shoot someone who is merely trespassing. I thought I had made it clear that it would require a direct threat of significant bodily harm or death. The law is quite clear on this.
It's one's own choice whether to defend oneself, flee, or simply submit to whatever an attacker has in store for them. LaughingBear spends a significant amount of time convincing the public at DUSA and elsewhere that OHV riders often become attackers when confronted while riding on fenced or posted private property, that such people are quite prone to violence. I'm simply suggesting what can not only preserve a private property owner's health, safety, and life, but what can also deter further attacks. It may be the only way.
Personally, I believe LaughingBear is exaggerating dramatically in order to convince the public that OHV riders who trespass are truly evil people, deserving of whatever legal restrictions can be placed on them. But that's my personal opinion. I don't believe it's that common, and we need to show some restraint when it comes to creating new legislation, despite the anger and frustration of private property owners.
Self defense should never be taken lightly, and taking the life of another human being would be a very traumatic event for anyone, regardless of the circumstances. I'm speaking from second-hand knowledge here, as I have personal friends who have had to take the life of an attacker.
But if the problem of violent OHV riders in Dave's neighborhood is as prevalent as he says it is, then it may be the only way to end it. Code Enforcement won't help you in this regard, neither will the Sheriff for that matter. Neither can respond until much later. As much as we feel they are here to protect and serve, the reality is that they are most often simply picking up the pieces and securing evidence for a criminal investigation.
No, we are not past violence in this society, nor will we ever be. As long as there are people willing to use unprovoked violence against others, we will have to be prepared to deal with them in a simlar way. The only way to deal with them is to lock them away until they are no longer a threat, or to kill them.
