Both the Moss Mill Rd. closure and opening J1299 through the cultural site were "Done Deals" made to BLM favorites. The Moss Mill Rd. closure was deliberately kept off the table. The current BLM Field Manager early advised that J1299 was a "Done Deal". The ensuing public storm over her declaration resulted in the reluctantly-given Comment Clarification meetings. These meetings unfairly excluded most of the public. However, at their conclusion the Field Manager stated that the public had been heard and gave her pledge that J1299 would not be opened.
At the meeting's conclusion, Ranger Nelson became angry and openly threatened one of the particpants. OHV Coordinator Mike Ahrens had conducted the Comment Clarification meetings, and was also clearly upset by loss of the "Done Deal". What to do? The Decision Table completed by Ahrens and Biologist Casey Burns had mandated closure of J1299. Opportunity presented itself on the departure of Burns. Ahrens modified the table deleting resource protection leaving the biogist's signature on the table. J1299 was again a "Done Deal".
Will Ahrens' falsification of a document and Ranger Nelson's attempted intimidation to silence opposition to the "Done Deal" be allowed to stand in court?
