An easement does exist. The Coastal Commission required provision of public access as a condition of development of beachfront and beach-adjacent private property. Because money was not spent on access formalization, property owners in those developments have been attempting to block the public.

Clearly, they are in the wrong, as recently adjudicated by the courts regarding ocean access on Broad Beach Rd., northwest of Zuma.
