No he does not there was a federal appeals court case in the 9th district that was not appealed, anything that is attached to the land permanently is included in the monetary value of the land, including plants, greens, etc. Therefore, cattlemen are stealing a part of private owners land (the grass and greenery) when their cattle eat it, thus subjecting them to conpensating the private owners whom have lost "land".

if you guys have a cattleman around and you see his cattle on your proerty grazing, you can actually keep the animal until the cattleman properly compensates you for the loss of your property, like a mechanics lien. I want to remind anyone though that is thinking of getting money from the cattlemen that grazing rights are traditionally not worth very much, mainly because cattlemen have argued successfully to the federal government that while, yes, the grass is technically land because it is permanently attached, that because it renews itself annually without cost once removed means that the government is really only losing one year's worth of renewable 'land', which cattlemen agreed to compensate the landowners for every year. Grazing rights per acre as a result have been very low for decades because BLM is by far the largest supplier of emply lands for grazing for cattle use, and the price per acre for grazing that they set usually ends up being the benchmark price for that year. Wish I could tell you what grazing rights are worth but its going a bit past my knowledge, but anyone interested could probably dig it up from BLM.
